Terms of Service

Agreement to these terms

Black & Red Management LLC, a Wyoming limited liability company doing business as StayInBoulder.CO (“StayInBoulder.CO,” “we,” “us,” or “our”) operates stayinboulder.co and the related vacation-rental booking experience (the “Site”). By using the Site, requesting a quote or hold, joining our email or text lists, or booking a stay, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site.

Bookings, payments, and cancellations

Reservations made through the Site are subject to the booking terms presented at checkout, including the rate, fees, taxes, damage-deposit terms, house rules, and the cancellation policy shown for your specific stay before you pay. Payments are processed by Stripe; we never store your full card details. Date holds requested through the Site are courtesy holds — they reserve nothing until a booking is completed and expire automatically.

Text messaging (SMS)

When you provide your phone number and tap “Text me” on the Site, you consent to receive marketing text messages from StayInBoulder.CO at that number. Messages may include availability alerts for dates you’ve asked about, quotes and date-hold updates, and occasional offers.

  • Consent is not a condition of booking. You can request a quote, hold dates, or book a stay without opting in to texts.
  • Message frequency varies. You can expect up to 4 messages per month, with more only around an active inquiry or stay.
  • Message and data rates may apply. Charges are billed by your mobile carrier under your plan.
  • Opt out any time by replying STOP to any message. We’ll send one final confirmation and nothing further. Reply HELP for help, or email hello@stayinboulder.co.
  • Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device.
  • You represent that the number you provide is your own. If you change or give up your number, please opt out or tell us so we don’t text the number’s next owner.

How we handle your number is described in our Privacy Policy. We never share, sell, or provide phone numbers collected for texting, or your opt-in status, to third parties or affiliates for their marketing or promotional purposes.

Using the Site

You agree to use the Site only for lawful purposes: browsing properties, making genuine inquiries, and booking stays. You may not scrape, disrupt, probe, or overload the Site, misrepresent your identity, submit false booking or contact information, or use the Site to send spam or unlawful communications.

Content and intellectual property

The Site’s content — photography, property descriptions, guides, text, and design — belongs to StayInBoulder.CO or its licensors. You may not reproduce or redistribute it for commercial purposes without our written permission.

Disclaimers

The Site is provided “as is.” We work to keep listings, calendars, and prices accurate, but availability and pricing are only final when a booking is confirmed. Travel guides and recommendations are provided for convenience and may change; verify details (hours, conditions, permits) with the venue or authority before relying on them.

Limitation of liability

To the fullest extent permitted by law, StayInBoulder.CO is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for claims relating to the Site or a stay is limited to the amount you paid us for the booking giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Boulder County, Colorado.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be announced by email or by a notice on the Site before they take effect. Continuing to use the Site after changes take effect means you accept the updated terms.
